


If you're looking for proof that collaborative divorce solutions work, you should check out a piece that ran earlier this week in the Kansas City Star.
The paper reported that the number of divorce cases that get to trial is on the decline, due primarily to collaboration and mediation options. Lawyers agree, perhaps grudgingly, that these alternatives work and can save people a lot of money. In one county alone, there are 800 orders for mediation this year. These approaches keep the courts from getting clogged and usually end up leaving both spouses more satisfied than a trial.
Collaborative divorce still costs money. You and your ex each have to find a lawyer or other professional to assist you. Everyone comes to the table and hashes out the issues. As one lawyer quoted in the piece points out, it's a system that allows you to tailor a solution that fits you, rather than having to adapt to the court's solution.
Even James Hennenhoefer, president of the American Academy of Matrimonial Lawyers, admits that this is a movement that's gaining steam. Maybe someday soon the bitter divorce trial will be an outdated relic.

It's about time, the only people who usually win in divorce are the lawyers, The losers the kids... Finally hope, and intelligence with parents who realize they are wasting precious time and energy which should be focused on the children making a recovering through this traumatic time for them. When I told my ex I wanted a divorce he was a free-lance business writer who actual believes to this day he had been working the last (then) 5 years. (He made about 9K 4 of those years, less the last one, and did nothing else for extra income.) I worked full-time for about 25K. He asked me as I was leaving for work one morning to check with my lawyer and see if we could use the same lawyer. About an hour and a half after I got to work I had time to call my lawyer and learned that yes, we could use just one lawyer. While we were on the phone a call came in to her office. Seems he couldn't wait for med to get back to him and had hired his own attorney. He told me later he couldn't wait all day to hear back from me. He had talked to a friend who advised him that if I already had a lawyer, he better get one of his own.
